The Erosion of Parental Rights

Biblically and constitutionally, the government has no business educating America's children, nor does the government have the right to forbid parents from disciplining their own children. This is an extremely important issue, and should give cause for alarm as there have been several cases over the past few decades that have continued a trend of excluding the rights of parents in the raising their own children. 

Being a parent is a huge responsibility that should not be taken lightly. Parents are not always right and some may be unfit. The reality is that children thrive in an environment where there is love and structure which includes consequences for their behavior. 

Being raised by a morally bankrupt institution whether by our Federal Government or the United Nations would be disastrous for our children, and for our nation. The legal decisions made by our courts the past few decades are a precursor to an even greater violation of parental rights that is headed our way in the encroaching New World Order. 

In 1987, a litigation of the Mozert v. Hawkins County Public Schools case was brought before the Sixth Court of Appeals regarding the expulsion of students who refused to read a series of books that violated their religious beliefs. The purpose of the lawsuit was to restore the right of these students to attend public school and to be given alternative sources of reading for their assignments. The main issue of this case was to determine whether parents and children who have sincere religious objections to public school curriculum have the right to alternative instruction for the objectionable material. The answer is no. 
 The Sixth Circuit Court of Appeals said, 
“Parents have no such right. Once a child has been submitted to the public schools for his education, parents lose all ability to control the course of instruction.” 
This case as well as many others is part of a growing trend of anti-parent bias in our federal courts. 
“The Mozert court held that there was no “burden” on religious freedom or parents’ rights when the schools forced children to read religiously offensive books as a condition of attending public schools”, says then attorney Michael Farris. 

One case that stands out is ruling of the well known Ninth Circuit Court of Appeals, with regards to a survey given to students in the elementary schools in the Palmdale School District of California. This was a psychological survey for the students which included a number of explicit sex-related questions. Of course, parents were outraged that the survey was conducted without disclosure to the parents. 
The Ninth Circuit held: 
Although the parents are legitimately concerned with the subject of sexuality, there is no constitutional reason to distinguish that concern from any of the countless moral, religious, or philosophical objections that parents might have to other decisions of the School District—whether those objections regard information concerning guns, violence, the military, gay marriage, racial equality, slavery, the dissection of animals, or the teaching of scientifically-validated theories of the origins of life. 
Schools cannot be expected to accommodate the personal, moral or religious concerns of every parent. Such an obligation would not only contravene the educational mission of the public schools, but also would be impossible to satisfy. 
The court went on to make it entirely explicit that once children are left at the public school’s front door, all parental control over the child’s education ceases
 Fields v. Palmdale School Dist., 427 F.3d 1197 (9th Cir. 2005). 

Unless parents’ rights are treated on a par with other fundamental rights, the government will continue to demand more and more authority over our children. It is time to put parents’ rights into the text of the United States Constitution. There is a new twist to this ongoing liberal agenda to usurp authority of the rights of a parent in the raising of their children; it is to ratify the UN Convention on the Rights of the Child.

Ever since the United Nations Convention on the Rights of the Child (UNCRC) was adopted by the United Nations General Assembly and opened to nations across the world for ratification in 1989, HSLDA has been deeply concerned about the implications of this treaty for U.S. homeschoolers, if the U.S. were to ratify the treaty. 

This is serious in regards to your rights as a parent! We didn’t need the UN when we were growing up, when our parents were growing up, or when our grandparents were growing up. The Convention on the Rights of the Child Treaty gives 18 individuals in the U.N. the power to control how you raise your children. 


Sen. Barbara Boxer is urging the U.S. to ratify a United Nations measure meant to expand the rights of children; a move that critics are calling a gross assault on parental rights that could rob the U.S. of sovereignty.

Critics say the treaty, which creates “the right of the child to freedom of thought, conscience and religion” and outlaws the “arbitrary or unlawful interference with his or her  privacy,” intrudes on the family and strips parents of the power to raise their children without government interference. Boxer has made clear her intent to revive the ratification process under the Obama administration, which may be amenable to the move. 

During a Senate confirmation hearing last month, Boxer said she considers it “a humiliation” that the U.S. is “standing with Somalia” in refusing to become party to the agreement, while 193 other nations have led the way. 
“To the extent that an outside body or group of unaccountable ‘so-called’ experts in Switzerland have a say over how children in America should be raised, educated and disciplined —is an erosion of American sovereignty,” said Steven Groves, at the Heritage Foundation. 
“Whether you ground your kids for smoking marijuana, whether you take them to church, whether you let them go to junior prom, all of those things . . . will be the government’s decision,” said Michael Farris, president of ParentalRights.org

“It will affect every parent who’s told their children to do the dishes.” On Monday, June 24, 2009, in a Harlem middle school, U.S. Ambassador to the United Nations Susan Rice told a group of 120 students that administration officials are actively discussing “when and how it might be possible to join” (that is, ratify) the UN Convention on the Rights of the Child (CRC).

As before, she also communicated what a disgrace it is that the U.S. would stand with only Somalia against such a widely accepted treaty. For the UNCRC to be ratified it must gain a two-thirds vote in the U.S. Senate (which they have, by the way) if this happens then the UNCRC will automatically supersede all state laws and U.S. judges will be obligated to follow the provisions of the treaty. 

Here we go, UN laws governing our sovereign nation? 
 Is there anyone who still believes that we aren’t losing our sovereignty as a nation? Currently, family and education laws are state-based; however, ratification of the UNCRC would transfer the jurisdiction for making family and education law to the U.S. Congress. Congress would, in turn, be obligated to follow the UN mandates contained in the CRC. 

The UNCRC infringes upon parental authority and represents a massive intrusion by the state into family affairs. It has the potential to radically alter parent-child relationships. The UN definitely has no business telling parents how to raise their children and neither does the government unless there is evidence of neglect or abuse. 

The UN is a morally bankrupt institution with a horrible record of protecting human rights around the world and the U.S ratifying the UNCRC will not change that. 
By the way, this is the first direct public statement by the Obama administration that it will seek ratification of the UN CRC. 

Ultimately, the answer to completely defeating the UNCRC is to amend the U.S. Constitution. This is the purpose of the Parental Rights Amendment being advanced by HSLDA and ParentalRights.org. The PRA would uphold the current U.S. legal framework which only allows the state to intervene where there is credible evidence of abuse or neglect. Otherwise parents are free to raise their children, which includes the right to home educate. 

Amending the Constitution will permanently protect the right of parents and homeschoolers. It's a right we cannot surrender to any U.S. government present or future and certainly a right we must not surrender to the United Nations. Text of S. J. Res. 16 Action: 

Here’s what we all need to do: 
1. Call the White House comments line at 202-456-1111. Tell them you heard the administration wants to ratify the CRC, and you strongly oppose this giving away of U.S. sovereignty to the UN. Also, keep in mind that this treaty gives the government jurisdiction to override any decision made by any parent if the government thinks that a better decision can be made—even if there is no proof of any harm. 
2. Call the Ambassador Susan Rice’s office at the United Nations. Tell her that you want her to represent the United States to the world rather than trying to get the United States to go along with international law initiated by the UN. Her office number is 212-415-4000. 
3. Contact your senators and urge them to oppose ratification of this treaty. (Find your senators’ contact information by using HSLDA’s Legislative Toolbox.) Ask them also to defeat it once and for all by cosponsoring SJRes 16—the Parental Rights Amendment.
